A. TERMS & CONDITIONS – CANDIDATES

1. General Information
These Terms & Conditions (“Terms”) govern the use of ArbeidMatch’s recruitment and staffing services by individuals (“Candidates”) and the use of the RecMan candidate platform.

By creating a profile or using our services, you accept these Terms.
2. Eligibility

Candidates must be 18 years or older.
-
Candidates must have the legal right to work in Norway or the EU/EEA where applicable.

ArbeidMatch may reject or remove profiles that do not meet legal or regulatory requirements.
3. Role of ArbeidMatch
ArbeidMatch operates as:
-
a recruitment intermediary (direct employment with the client), and/or
-
a staffing employer (bemanning), where the candidate is employed by ArbeidMatch Norge AS.
ArbeidMatch does not guarantee:
-
employment,
-
assignment duration,
-
salary level,
-
job continuity or placement outcome.
Final hiring decisions are always made by human decision-makers.
4. Candidate Obligations
Candidates must:
-
provide true, accurate and complete information,
-
ensure documentation (CV, certificates, references) is authentic,
-
update their profile when circumstances change,
-
comply with workplace rules, HMS requirements and lawful instructions.
Providing false or misleading information may result in immediate termination of process, employment, or access to services.
5. Employment and Assignments
5.1 Recruitment
If recruited for direct employment, the employment contract is between the Candidate and the Client. ArbeidMatch is not a party to the employment contract.
5.2 Staffing (Bemanning)
If employed by ArbeidMatch Norge AS:
-
employment is governed by Norwegian labour law,
-
assignments are temporary and depend on client demand,
-
work location, duration and conditions may vary.
6. Data Protection and RecMan
Candidates manage their personal data through RecMan and may:
-
access and update data,
-
withdraw consent where applicable,
-
permanently delete their profile at any time.
Processing is governed by GDPR and Norwegian data protection law.

7. Suspension and Termination
ArbeidMatch may suspend or terminate access to RecMan or services if:
-
these Terms are breached,
-
false information is detected,
-
legal, regulatory or compliance risks arise.
Such actions may be taken without prior notice where justified.
8. Limitation of Liability
To the extent permitted by Norwegian law:
-
ArbeidMatch is not liable for indirect or consequential losses,
-
ArbeidMatch is not responsible for employer decisions, workplace conditions at client sites, or third-party actions.
9. Governing Law and Jurisdiction
These Terms are governed by Norwegian law.
Any disputes shall be handled exclusively by:
-
Trondheim forliksråd, and/or
-
Trondheim tingrett.
10. Acceptance
By creating or maintaining a RecMan profile or using ArbeidMatch services, you confirm acceptance of these Terms.
B. TERMS & CONDITIONS – CLIENTS (B2B)

1. General Provisions
These Terms apply to all recruitment and staffing services provided by ArbeidMatch Norge AS (“ArbeidMatch”) to corporate clients (“Client”).
Use of ArbeidMatch services constitutes acceptance of these Terms, in addition to any signed agreements.
2. Scope of Services
ArbeidMatch provides:
-
Recruitment services (direct employment by Client), and/or
-
Staffing services (bemanning) where candidates are employed by ArbeidMatch Norge AS.
Specific commercial terms are regulated by separate written agreements, service packages or confirmations.
3. Client Responsibilities
The Client shall:
-
provide lawful, non-discriminatory and realistic job requirements,
-
comply with equal treatment obligations under Arbeidsmiljøloven §14-12 a–c,
-
ensure safe working conditions and full HMS compliance,
-
provide necessary onboarding, access and safety training.
The Client is responsible for workplace management and daily supervision at the assignment site.
4. No Circumvention / Non-Solicitation
Clients may not:
-
hire, contract or engage candidates presented by ArbeidMatch outside agreed frameworks,
-
bypass ArbeidMatch to avoid fees,
-
share candidate information with third parties without consent.
Violation may result in contractual penalties or compensation claims.
5. Fees, Invoicing and Payment
-
Fees are defined in signed agreements or confirmations.
-
Payment terms are 0 or 14 days, as stated on the invoice.
-
Late payments accrue statutory interest under Forsinkelsesrenteloven.
-
ArbeidMatch may suspend services for non-payment.
All invoices are non-refundable, unless explicitly agreed otherwise in writing.
6. Liability and Disclaimer
ArbeidMatch:
-
does not guarantee candidate performance or retention,
-
does not guarantee authenticity of third-party documents beyond reasonable checks,
-
is not liable for indirect or consequential losses.
The Client remains fully responsible for compliance with Norwegian labour, tax and HMS legislation.
7. Confidentiality and Data Use
Candidate data provided by ArbeidMatch is confidential and may only be used for the agreed recruitment or staffing purpose.
Unauthorized use or disclosure constitutes a material breach.
8. Force Majeure
ArbeidMatch is not liable for delays or failures caused by events beyond reasonable control, including strikes, IT failures, regulatory actions or force majeure events.
9. Termination
ArbeidMatch may terminate or suspend services immediately in case of:
-
breach of these Terms,
-
non-payment,
-
legal or compliance risk.
Termination does not affect accrued payment obligations.
10. Governing Law and Venue
These Terms are governed by Norwegian law.
Disputes shall be resolved exclusively by:
-
Trondheim forliksråd, and/or
-
Trondheim tingrett.
11. Acceptance
By engaging ArbeidMatch services, the Client confirms acceptance of these Terms.
