1. General Provisions
1.1 Definitions

ArbeidMatch: Norwegian recruitment and staffing company, legally registered as ArbeidMatch Norge AS, Org. no: 935 667 089, with registered office at Sverre Svendsens veg 38, 7056 Ranheim, Norway. ArbeidMatch provides recruitment, staffing (bemanning), and operates the digital platform RecMan for candidate management, in compliance with Norwegian legislation.

RecMan: The Applicant Tracking System (ATS) and candidate portal operated by ArbeidMatch, used to process applications, store personal data, match profiles, and manage documentation under GDPR and the Norwegian Personal Data Act.

Employer / Client: A company registered in Norway that enters into staffing or recruitment agreements with ArbeidMatch Norge AS.

Candidate: An individual who creates a profile in RecMan to apply for job opportunities or assignments, and whose data is processed for staffing or recruitment purposes.
1.2 Governing Law
These terms, and all services provided by ArbeidMatch, are governed by Norwegian law, including:

the Working Environment Act (Arbeidsmiljøloven),
-
the Staffing Agency Regulation (Forskrift om bemanningsforetak),
-
the Personal Data Act (Personopplysningsloven),
and the EU GDPR as implemented in Norway.
1.3 Eligibility

Candidates must be at least 18 years of age.

Employers / clients must be Norwegian-registered entities listed in the Brønnøysund Register Centre.

All parties must comply with Norwegian labor regulations, HMS requirements, and guidelines from Arbeidstilsynet.
2. Scope of Services
2.1 Recruitment and Staffing
ArbeidMatch provides:

Recruitment services, facilitating direct employment of candidates by clients.

Staffing services (bemanning), where candidates become employees of ArbeidMatch Norge AS under Norwegian employment contracts and are leased to clients pursuant to §14-12 of the Working Environment Act.
2.2 Use of RecMan by Candidates

Candidates manage their applications and profiles exclusively through RecMan, where they submit CVs, track applications, and give explicit consent for data processing.

RecMan allows candidates to update or permanently delete their data and profiles at any time, fully exercising their rights under GDPR.
3. Responsibilities and Conduct
3.1 Employers / Clients
-
Engage ArbeidMatch through direct staffing or recruitment contracts, without creating RecMan accounts.

Must provide realistic, lawful job requirements, comply with equal treatment and pay obligations under §14-12 a-c Arbeidsmiljøloven, and ensure workplace safety (HMS) for ArbeidMatch employees on assignment.
3.2 Candidates

Must provide truthful and complete information in RecMan profiles and throughout any recruitment or staffing process.

When employed by ArbeidMatch Norge AS, candidates are governed by Norwegian employment law.
3.3 General Conduct
Fraud, harassment, discrimination, or misuse of services is strictly prohibited. Violations may result in account suspension, termination of agreements, or legal action.
4. Accounts, Contracts, and Verification
4.1 Employers / Clients

Do not create user accounts in RecMan. Collaboration takes place through direct commercial contracts or staffing agreements, in line with Norwegian business practice.

ArbeidMatch conducts all necessary due diligence and verification through public registers (including the Brønnøysund Register Centre) before commencing services.
4.2 Candidates
-
Must create and manage profiles in RecMan for applications, documentation, and to exercise GDPR rights.
4.3 Employment Contracts
-
In staffing (bemanning), employment contracts are entered directly between ArbeidMatch Norge AS and the employee, governed by Norwegian labor law, with assignments to clients regulated by separate agreements.

In recruitment, ArbeidMatch facilitates the process, and the employment contract is directly between the candidate and the client company.
5. Fees, Payment and Invoicing
5.1 Service Fees
Employers / clients agree to pay all fees for recruitment or staffing services as specified in signed agreements or confirmed service packages.
5.2 Payment Deadlines

Invoice payment terms are strictly limited to immediate payment (0 days) or 14 days from the invoice date, as set out in the specific agreement.

The applicable term will always be clearly indicated in each invoice or underlying contract.
5.3 Late Payments
-
Invoices not paid by the due date will accrue statutory late payment interest under the Norwegian Interest on Overdue Payments Act (Forsinkelsesrenteloven) and may be recovered under the Norwegian Debt Collection Act (Inkassoloven).

Persistent late payments may lead to suspension of services, termination of contracts, or legal enforcement.
6. Refunds

ArbeidMatch Norge AS does not offer refunds on issued invoices.

All fees for recruitment and staffing services are non-refundable once invoiced, unless explicitly agreed otherwise in a separate written contract.
7. Data Privacy and RecMan

ArbeidMatch processes personal data through RecMan, in accordance with GDPR, the Norwegian Personal Data Act, and supervisory guidance from Datatilsynet.

Candidates may log into RecMan at any time to update, restrict processing, or permanently delete their data and profiles, fully exercising their GDPR rights.

8. Intellectual Property
All technology, scripts, branding, and platform content used by ArbeidMatch and in its implementation of RecMan remain the exclusive property of ArbeidMatch Norge AS.
No copying, redistribution, or commercial exploitation is permitted without prior written consent.
9. Force Majeure
ArbeidMatch is not liable for delays or service interruptions resulting from events beyond reasonable control, including strikes, IT system failures, natural disasters, or regulatory directives.
10. Dispute Resolution
These terms are governed by Norwegian law. Any disputes will be resolved exclusively by:

Trondheim tingrett (District Court) or
-
Trondheim forliksråd (Conciliation Board).
11. Termination
ArbeidMatch reserves the right to suspend or terminate services in case of breaches of these terms, persistent non-payment, or misuse. Repeated violations may result in permanent exclusion and legal claims under Norwegian contract or tort law.
12. Disclaimer of Liability
ArbeidMatch operates strictly within Norwegian staffing and recruitment law. While facilitating matching and assignments, we do not guarantee specific employment outcomes. Employers / clients remain fully responsible for complying with all obligations under Norwegian labor and HMS law.

14. Acceptance of Terms
By using ArbeidMatch’s staffing, recruitment, or RecMan platform services, all users confirm they have read, understood, and accepted these Terms under Norwegian law.
15. Amendments
ArbeidMatch reserves the right to update these terms in compliance with Norwegian legislation. Significant changes will be communicated via email or RecMan notifications.
